These Terms of Use (this “Agreement” or “EULA”) govern your use of the Dry Day AI app and website (the “Service”), operated by Ovalike AI (“we,” “our,” or “us”). By creating an account or using the Service you agree to these terms.

Eligibility

You must be at least 17 years old to use the Service. The Service discusses alcohol, sobriety, and substance use; it is not intended for children.

Your Account

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@drydayai.com if you suspect unauthorized access.

Not Medical Advice

Dry Day AI is a self-help tool. It is not a substitute for professional medical, psychiatric, or addiction treatment. The AI Coach and SOS Crisis Mode are not emergency services and cannot diagnose or treat any condition.

Stopping heavy alcohol use suddenly can be dangerous and even fatal. If you drink heavily every day, talk to a doctor before quitting. In a medical or mental-health emergency call 911, the Suicide & Crisis Lifeline at 988, or SAMHSA at 1-800-662-4357.

Subscriptions

Plans and pricing

Dry Day AI Pro is offered as an auto-renewable subscription:

• Monthly: US$9.99 per month, billed every 1 month.
• Annual: US$49.99 per year, billed every 12 months.

New subscribers may be eligible for a 3-day free trial of the monthly plan, after which the subscription auto-renews at the standard price unless cancelled. Prices in other currencies are set by Apple’s App Store Pricing Matrix and may vary by region.

Auto-renewal

Subscriptions automatically renew at the end of each billing period (1 month or 12 months) at the then-current price unless you cancel at least 24 hours before the end of the current period. Your payment method will be charged within 24 hours before the new period begins.

How to cancel

Subscriptions purchased on iOS are billed through your Apple ID. Manage or cancel them at any time in iPhone Settings → Apple ID → Subscriptions, or via apps.apple.com/account/subscriptions. Deleting the app does not cancel the subscription.

Subscriptions purchased on the web are billed through Stripe. Manage or cancel them at any time in Settings → Subscription inside the app.

Refunds

Subscriptions are non-refundable except where required by law. Refund requests for purchases made through Apple must be submitted to Apple via reportaproblem.apple.com — we cannot issue refunds on Apple’s behalf. For web purchases, contact support@drydayai.com.

Free trial eligibility

Apple grants one introductory offer (such as a free trial) per subscription group per Apple ID. If you have previously used a trial, switching plans starts paid billing immediately.

Acceptable Use

You agree not to:

• Use the Service to harm yourself or others
• Reverse-engineer, copy, or resell the Service or any of its content
• Attempt to access another user’s account or our backend systems
• Use the Service to send spam, harassment, or unlawful content
• Submit content that infringes anyone else’s rights

We may suspend or terminate accounts that violate these terms or that put other users at risk.

Your Content

You retain ownership of the messages, check-ins, and data you submit to the Service. You grant us a limited license to store and process that content solely to provide the Service to you (e.g., generating AI Coach responses, syncing across devices).

We do not sell your content, share it with advertisers, or use it to train third-party AI models. See our Privacy Policy for details.

Intellectual Property

The Service, including its software, design, copy, and branding, is owned by Ovalike AI and protected by copyright, trademark, and other laws. Nothing in this Agreement transfers any of those rights to you.

Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI Coach responses will be accurate or appropriate for your situation.

Limitation of Liability

To the maximum extent permitted by law, Ovalike AI and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or US$100, whichever is greater.

Termination

You may stop using the Service at any time and delete your account inside the app. We may suspend or terminate access if you violate these Terms or if continued operation would expose us to legal risk. Sections of these Terms that by their nature should survive termination (e.g., disclaimers, limitation of liability, governing law) will continue in effect.

Apple-Specific Terms

If you obtained the Service from the Apple App Store, the following additional terms apply. They are required by Apple and apply only to the iOS app:

• This Agreement is between you and Ovalike AI only — not with Apple. Apple is not responsible for the Service or its content.
• Apple has no obligation to provide any maintenance or support for the Service.
• If the Service fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
• Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession or use of the Service.
• In the event of any third-party claim that the Service or your possession and use of the Service infringes that party’s intellectual property rights, Ovalike AI — not Apple — is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in California, except where prohibited by applicable consumer-protection law.

Changes

We may update these Terms from time to time. Material changes will be announced via in-app notice or email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
